Mediation FAQ
Below please find helpful responses to some commonly asked divorce mediation questions.
What is mediaton?
Mediaiton is a process of addressing and resolving all legal issues relating to a divorce or separation with the assistance of an impartial divorce mediator.
Will I be divorced upon completion of the mediation process?
Our all-inclusive divorce mediation services include the preparation of the Marital Separation and Property Settlement Agreement. Once this document is signed by both you and your spouse it is a legally binding agreement that results in a legal separation. The filing of this agreement and some ancillary documents with the courts and the review and approval of the agreement and documents by the courts results in a divorce.
Why should I go to a divorce mediator instead of initiating an adversarial process?
Mediation is considerably more affordable, more efficient, and less stressful. The result of both mediation and an adversarial process is the same in that it results in a legally binding agreement that governs the terms of your separation or divorce. However, the lower costs and greater emotional benefits associated with mediation is the reason why mediation has become the approach recommended by the New York courts. Acting adversarially is never beneficial as you and your spouse will lose control over all disputes and comprimises and will likely be forced to live with an agreement that fosters on-going tension and court intervention.
What if my spouse does not agree to a divorce, separation or the mediation process?
We have the expertise and experience necessary to address all situations, including situations where parties disagree on (i) numerous issues relating to the divorce or separation, (ii) the divorce or separation itself, or (iii) the approach to be used to obtain a divorce or separation.
How long does divorce mediation take?
We are typically able to successfully resolve all issues relating to a divorce or separation in as little as 3 meetings, but in certain situations additional meetings may be required depending on the particular facts and circumstances. The process of filing a divorce and getting it approved by the courts takes approximately 4 months.
How much does divorce mediation and legal separation cost?
Our highly effective New York divorce mediation service provides our clients with affordable and efficient results. When compared to an adversarial process or the process commonly employed by other mediators who do not typically cover all issues in the initial meeting or distribute a draft settlement agreement early on in the process, our all-inclusive service is the most sensible choice. In addition, we do all the work necessary to successfully file with the court.
